APPLICATION: Reinstatement; remand
The respondents are natives and citizens of Mexico. On March 1, 2002, the Board continued proceedings indefinitely. On March 29, 2010, the respondents filed a motion. The lead respondent (A029 226 786) requests reinstatement of proceedings and a remand so that she may pursue an application for adjustment of status. The rider (A070 974 584) requests that proceedings remain continued indefinitely. [FN1] The Department of Homeland Security (“DHS”) has not filed a response. Accordingly, the following orders shall be issued.
ORDER: The order of this Board dated March 1, 2002, is vacated and the proceeding is reinstated with respect to the lead respondent (A029 226 786).
FURTHER ORDER: The record is remanded to the Immigration Judge for further proceedings consistent with this decision with respect to the lead respondent.
